NASHVILLE, Tenn. — Alliance Defense Fund attorneys representing a majority of Tennessee Legislators against a legal attack by the ACLU upon the state’s proposed marriage amendment will be available to answer questions from the media following oral argument at the Tennessee Supreme Court on Wednesday.

“The ACLU wants the court to hand them a political victory they fear they wouldn’t be able to get from the people,” said ADF Senior Legal Counsel Byron Babione.  “The Legislature, out of respect for the law, wants the voters of Tennessee to decide whether their Constitution will protect marriage as a union between one man and one woman.”

The ACLU of Tennessee sued state officials to try to prevent the people of Tennessee from voting on a constitutional amendment proposed by state lawmakers that defines marriage as a union between one man and one woman.  ACLU attorneys appealed the case after a lower court judge dismissed the suit on Feb. 23 (www.telladf.org/news/story.aspx?cid=3690).

“The ACLU does not want the people to have a say in the matter,” said ADF-allied attorney David Maddox, serving as co-counsel on the case.  “The ACLU is demanding that the Court keep the question off the ballot.”
