Oklahoma Supreme Court: Judge okay to vacate same-sex couple’s “divorce” - 7.2.08

The Oklahoma Supreme Court ruled Tuesday that a state judge acted within his authority when he vacated a divorce unknowingly granted to two women. Alliance Defense Fund attorneys filed a friend-of-the-court brief in the case in October 2007 on behalf of then-Oklahoma Speaker of the House Lance Cargill, arguing that the state cannot grant a divorce to two people when the state does not even recognize them as married. read more...


1st Circuit: “Don’t Ask, Don’t Tell” policy is constitutional - 6.9.08

The U.S. Court of Appeals for the 1st Circuit ruled Monday that the military’s “Don’t Ask, Don’t Tell” policy on homosexual behavior does not violate the U.S. Constitution. As argued in a friend-of-the-court brief funded by the Alliance Defense Fund and filed by the National Legal Foundation, the court determined that the policy is constitutional because it is based upon important considerations of military life, not irrational fears or prejudices. read more...


Wisconsin marriage amendment upheld - 5.30.08

A Wisconsin court threw out a challenge to the state’s marriage amendment Friday, ruling that the amendment does not violate state law. Alliance Defense Fund attorneys had filed a friend-of-the-court brief arguing for the constitutionality of the amendment. read more...


6th Circuit upholds protections for Grand Rapids citizens against sex shops - 5.27.08

The U.S. Court of Appeals for the 6th Circuit has ruled that an ordinance restricting sexually-oriented businesses is constitutional, upholding a lower court’s decision in the case. Court affirms will of Oregon voters: marriage amendment constitutional - 5.22.08

An Oregon appeals court ruled Wednesday that Measure 36, the state’s constitutional amendment affirming marriage as the union between one man and one woman, is constitutional. Maryland high court affirms parental rights for fit parents - 5.20.08

The Maryland Court of Appeal ruled Monday in favor of a mother defending her parental rights against a non-parent’s claim to her eight-year-old girl. Mich. Supreme Court ruling protects marriage, taxpayers from ACLU demands - 5.7.08

The Michigan Supreme Court ruled 5–2 Wednesday that the state’s constitutional amendment protecting marriage does not allow for the extension of taxpayer-funded benefits to the unmarried “domestic partners” of state and municipal employees. ADF attorneys filed a friend-of-the-court brief in the case, arguing that the state can extend benefits to whomever it wishes so long as it doesn’t do so on the basis or a marriage-like status prohibited by the Michigan Constitution. read more...


ADF: Foreign same-sex “marriage” issue unresolved in New York - 5.7.08

Although the New York Court of Appeals declined to hear an appeal from an appellate court’s decision holding that municipalities must recognize foreign same-sex “marriages” in the Empire State, Alliance Defense Fund attorneys point out that the final word has not yet been heard on the issue. The court reasoned that it could not hear the case because the lower court’s decision had yet to “finally determine the action.” Once that occurs, the Court of Appeals may again be asked to consider the case. read more...

Illinois school must allow “Be Happy, Not Gay” T-shirt - 4.23.08

The U.S. Court of Appeals for the 7th Circuit reversed a lower court’s ruling against an Illinois student Wednesday, saying the district court must order a Naperville high school to suspend its ban on a T-shirt that reads “Be Happy, Not Gay” while the student’s lawsuit proceeds. Porn operators lose again - 2.29.08

A Florida appellate court has upheld a ruling in favor of a homeowners’ association that claimed a group of men leasing a house in its neighborhood were violating its restrictions on running a business out of a home. The men installed 24 cameras in the house and charged customers to view their sex acts on a Web site, the ADF-supported lawsuit claims. read more...


6th Circuit rules in favor of Boyd County student, reinstates free speech case - 10.26.07

Attorneys with the Alliance Defense Fund have succeeded in their appeal of a federal judge’s decision against a Boyd County, Ky., student. A former school district policy prohibited the student from saying to other students that homosexual behavior is wrong. The U.S. Court of Appeals for the 6th Circuit Friday reversed a ruling in favor of the school district and sent the case back to trial. read more...


Ohio judge issues ruling upholding community safeguards placed on sexually-oriented businesses- 10.22.07

A federal judge has issued a ruling in favor of an Ohio statute defended by an Alliance Defense Fund allied attorney that limits the negative effects of sexually-oriented businesses. Attorneys representing sexually-oriented businesses throughout Ohio attempted to prevent cities and counties around the state from enforcing the statue, but the court denied their motion for a temporary restraining order Thursday. read more...


ADF attorney: Federal appeals court rejects demand of “transsexuals” for special rights- 9.26.07

A federal appeals court has issued a significant ruling saying that an employer’s concern over the use of restrooms by “transsexual” employees is legitimate, according to Alliance Defense Fund Senior Legal Counsel Brian Raum. In a victory for families, the U.S. Court of Appeals for the 11th Circuit ruled Thursday that Daytona Beach ordinances restricting alcohol and nudity in sexually-oriented businesses are constitutional. Danbury High School agrees to allow Day of Truth activities after receiving letter from ADF attorneys- 4.5.07

After receiving a letter from attorneys with the Alliance Defense Fund, the principal of Danbury High School agreed Wednesday to allow a student to promote and participate in the Day of Truth after first having prohibited the student from doing so. The school officially endorses the Day of Silence, an event promoting the homosexual agenda, but had thwarted student Rosemary Shakro’s attempts to promote the Day of Truth by inviting a speaker to a club meeting and posting signs announcing the event. read more...

Court halts N.C. school district policy used to prohibit student from distributing “Day of Truth” cards- 11.2.06

A federal judge today issued a preliminary injunction prohibiting the Sampson County Board of Education and Midway High School officials from enforcing two policies used to prohibit a student from distributing “Day of Truth” message cards to other students. Officials prohibited the student, represented by attorneys with the Alliance Defense Fund, from distributing the cards outside of class time during the event April 27 and suspended him from school. read more...

A federal judge determined Monday that officials with the School District of the City of Saginaw violated the First Amendment rights of a student represented by attorneys with the Alliance Defense Fund. School officials forbade the student, Joel Curry, from “selling” candy canes to classmates as part of a classroom marketing project until he removed a Christian message about the significance of the candy cane that was attached to each one. read more...


Grand Rapids citizens win first battle against neighborhood ‘sex shops’- 9.7.06

Local citizens determined to protect their families from sexually oriented businesses have won their first legal battle. A group of sex-shop owners who filed suit against the city of Grand Rapids have lost their bid for a preliminary injunction, which would have halted enforcement of the city’s newly adopted ordinance. The measure places time, place, and manner restrictions on the businesses in order to curb the secondary effects of their presence. read more...


Ariz. high court gives final word: state’s voters will have say on marriage amendment- 8.31.06

Home at last: Parish finally agrees to issue permit for construction of home for unwed teen mothers- 8.31.06

Teen mothers hoping for a place to call home will soon have their wish. River of Compassion Ministries, which had been denied a conditional use permit to build a home for unwed teenage mothers, will now be allowed to continue with its building project after St. Tammany Parish officials agreed to settle a lawsuit over the matter. read more...
