Situation
In recent years, groups such as the ACLU have turned to the advocacy of “international law” to advance their legal and cultural agenda. These groups have realized that the United States Constitution can only be stretched so far, and therefore they need to look to other methods to achieve their goals. The result is a growing use of, and reliance on, foreign case law as legal precedent in American courts deciding domestic legal questions. This is contrary to the Constitution, as well as our country's heritage and poses a grave threat to the sovereignty of our nation and the freedoms we enjoy as people of faith.
ContextADF is actively training our army of allied attorneys to defend America’s sovereignty and the freedoms that millions have died to protect. The ACLU and its allies are actively promoting the use of foreign law to interpret the United States Constitution in order to find new “rights” that our founding fathers never intended.
ResponseFirst, ADF and its allied attorneys are fighting in the courts to stop the importation of foreign case law to interpret the United States Constitution. Second, ADF is strategically litigating key religious liberty cases abroad in order to prevent the creation of harmful foreign case law that might otherwise be imported by the ACLU into American courts. Third, ADF is giving Christian lawyers and law students the tools to fight foreign case law through its
National Litigation Academy sessions and
Blackstone Legal Fellowship.

Federalist 42 - "Felony is a term of loose signification, even in the common law of England; and of various import in the statute law of that kingdom. But neither common nor the statute law of that, or any other nation, ought to be a standard for the proceeding of this, unless previously made its own by legislative adoption." (
