October 2, 2007Several years ago, those unhappy with America's religious history and heritage realized the Constitution was - as John Adams said -
"...made only for a moral and religious people. It is wholly inadequate for the government of any other." Realizing this, and seeing that the Constitution could only be stretched so far, the ACLU and its allies have sought a new weapon in their fight against religious freedom: The use of foreign law. As the ACLU's executive director has said:
"It is clear that we can no longer count on the Constitution alone to protect fundamental freedoms in the United States ... we must emphasize the positive face of globalism." [emphasis added]
What does that mean?
It means that the ACLU wants
foreign case law to be cited as legal precedent in American courts for deciding domestic legal questions.
Imagine that the human resources manager at your company announces you are being fired for violating company dress code policy. Not the code of your own company, but that of another company in another country, whose policies the manager has suddenly decided to adopt and apply to your particular situation.
Outrageous? YES - and that's what happens when American judges cite rulings from courts in other countries in their decisions to interpret
our Constitution. Five current U. S. Supreme Court justices have expressed support for applying foreign law to High Court interpretations of what the Constitution means and how it should be applied.
ADF has worked hard to combat this trend -- training our allied attorneys and fighting in the courts to stop this use of foreign case law, while
litigating strategic cases abroad in order to prevent harmful case law from being established there and imported here.
