NY high court sidesteps central issue in cases that challenged same-sex ‘marriage’ recognition
New York’s highest court did not address the central issue in a ruling Thursday on two lawsuits that challenged the state’s attempt to recognize out-of-state same-sex “marriages” by state and county officials, say attorneys with the Alliance Defense Fund who brought the suits.

ADF joins legal battle to defend rights of voters in DC
Attorneys with the Alliance Defense Fund filed suit Wednesday against the District of Columbia Board of Elections and Ethics for precluding the right of citizens in the district to vote for or against the definition of marriage. The board determined Tuesday that a citizen initiative that would allow voters to either uphold or reject the longstanding definition of marriage as the union of one man and one woman is not a proper subject for the ballot because of a law passed by the D.C. Council. ADF and Stand4MarriageDC attorneys argue that the board’s reasoning is invalid.

Maine churches threatened with IRS complaints for supporting marriage
Attorneys with the Alliance Defense Fund are offering free legal assistance to Maine churches that become the targets of Internal Revenue Service complaints in the wake of Question 1. Question 1 opponents are actively encouraging their followers to report churches to the IRS in the wake of their unsuccessful effort to block voter approval of the measure, which restored the legal definition of marriage in the state to one man and one woman.

City of St. Louis agrees to end unconstitutional literature distribution policy
The city of St. Louis has agreed to scrap a problematic literature distribution policy after a federal court ordered the city to stop enforcing it as part of a lawsuit filed by an Alliance Defense Fund allied attorney. The policy was used to prohibit members of a Christian ministry from distributing literature and speaking about their religious viewpoint at an annual “PrideFest” event that celebrates homosexual behavior. The ministry filed a voluntary dismissal of its lawsuit Wednesday after reaching an agreement with the city.

Texas judge declares state marriage law, state DOMA unconstitutional to hear same-sex ‘marriage’ suit
A Dallas judge ruled on Thursday to hear a “divorce" lawsuit between two men whose same-sex “marriage” was performed in Massachusetts, declaring the state marriage amendment and the state’s Defense of Marriage Act unconstitutional. The Texas Attorney General will appeal the ruling and Alliance Defense Fund attorneys are planning to file a friend-of-the-court brief opposing the Texas court’s ruling, which moves to recognize the men’s out-of-state same-sex “marriage” in defiance of the Texas Family Code and a voter-approved constitutional amendment recognizing marriage as between one man and one woman.
