SAN FRANCISCO — After a prolonged legal battle, two Arizona companies represented by attorneys with the Alliance Defense Fund have reached a settlement dismissing all claims against the companies and their managers, Dale Gwilliam and Nathan Gwilliam.
Adoption Profiles, L.L.C., which operates an online service that posts profiles of potential adoptive parents on its ParentProfiles.com Web site for review by the birth parents of newborn adoptable children, will no longer accept profiles from California residents under the terms of the settlement. Adoption Media, which operates Adoption.com and associated Web sites, will be unaffected by the settlement because there was no allegation that any of its business practices were discriminatory.
“This settlement is a tremendous victory. We are pleased that Adoption Media has been vindicated in this settlement because its practices were not even arguably discriminatory,” said ADF Senior Counsel Glen Lavy. “Adoption Profiles can continue to serve parents and children alike without betraying the principles upon which it was founded.”
On Oct. 21, 2002, Michael Butler and Richard Butler submitted an application to have their profile displayed on the ParentProfiles.com web site. After their application was not approved, the two men filed the suit

“The only thing that the National Center for Lesbian Rights and the San Francisco law firm of Orrick, Herrington & Sutcliff achieved through this litigation is that no potential adoptive parents in California will have the opportunity to take advantage of the service provided by the ParentProfiles.com website,” said Lavy. “Californians are the poorer for this attempt to misapply the non-discrimination laws of California to the Internet business of an Arizona company.”
Last year, after more than a century of service, Catholic Charities in Boston was forced to close its doors to children waiting to be adopted because it could not betray its own moral principles to satisfy the homosexual agenda in its state.
